I just got this email...

I wrote to the Family Law Facilitator in Shasta County (where I filed my divorce papers last November) to get some advice on how to proceed with matters since my ex has done nothing but try to make things more difficult for me. I also addressed some possible issues with the case. This (in quotes) is what I got back today:

"First of all, a birth certificate does not have the force and effect of a
judicial finding of paternity."

YAY! This means my doctor is a moron!.... hey wait a minute... Oh well, I didn't like her anyhow. It's just too late in my pregnancy to switch doctors (I'm not that motivated).

She told me that if I was still married at the time of my delivery I wouldn't have a choice in whether or not his name was placed on the birth certificate.

"Secondly, Mr. *jerkface* filed his Responsive Declaration in your case on
3-21-07 as well as an At-Issue Memorandum.  This last document is a petition
for a settlement conference, the necessary next step in your case. You will
be notified of the actual court date, time, and Department.  It will be 2 to
3 months down the road.  Once you receive this notice you should contact the
Shasta County Court Clerk's Office (1500 Court St., Room 319, Redding,
96001) since the court date may be right around your estimated time of
delivery.

Nothing further has been filed in his case (159193.) You filed first and
served him first so your case trumps his filing."

HELLS YES!!

Now what doesn't make sense to me: when he called me the other day, he argued that the cases were not conjoined and that he had not filed a response. Thus the case would go into default if I filed one last paper and we would be done and over with as of Auguest 8, 2007. This happens to be the same day that he filed his paperwork (the 21st) that I spoke with him. Also he filed all of this one week after his 30 day time limit to respond after being served.

*shrugs*
Who knows. But I DID get a call from the probation department - I guess he is applying for a new job and he LIED to them and told them that he didn't know how to contact me and that we were already divorced..... 2 things I am sure that they will be interested in knowing. I'm sure I can think of a few more things to inform them of in all honesty as well.
